The rush to deploy Artificial Intelligence is comparable to the cloud migration boom of the early 2010s, but with significantly higher stakes. However, for the C-Suite and Board, it introduces a new category of “Black Box” risk that traditional compliance frameworks are ill-equipped to handle.
With the EU AI Act now operational and the NIST AI Risk Management Framework (AI RMF 1.0) becoming the benchmark in the US, the era of “move fast and break things” is over. The new mandate is “move fast and build guardrails.”

- Action: Immediate ban. Under Title II of the EU AI Act, these practices carry the highest tier of penalties.
2. High Risk (Heavily Regulated) These systems affect critical decision-making or safety.
- Examples: AI used in employment recruiting, credit scoring, medical device software, or critical infrastructure.
- Requirement: These require a “Human-in-the-Loop” (HITL) protocol. You must perform a rigorous Data Protection Impact Assessment (DPIA) and ensure training sets are free of bias.
3. Limited Risk (Transparency Required)
- Examples: Customer service chatbots or emotion recognition systems.
- Requirement: The “Transparency Principle.” Users must be explicitly informed that they are interacting with a machine.
4. Minimal Risk (Unregulated)
- Examples: Spam filters, inventory management AI, or predictive maintenance tools.
- Action: No specific restrictions, though standard data privacy laws (GDPR/CCPA) still apply.
